Terms of Service

Article 1 (Application)

1. These Terms are intended to set out the conditions for providing the Service and the rights and obligations between us and registered users regarding use of the Service.
2. Any individual guidelines or similar rules posted by us within the Service (the “Individual Rules”) form part of these Terms regardless of their name. If these Terms conflict with the Individual Rules, the Individual Rules prevail.

Article 2 (Definitions)

Terms used in these Terms have the following meanings.

• “We” or “us” means the operator of the Service. Please refer to the seller information or support information on the App Store for the official business name and address.
• “You” means any person who agrees to these Terms and uses the Service.
• “Registration Data” includes records, condition logs, weight, step count, and other data that you enter into or sync with the Service.

Article 3 (Accounts)

1. You may create an account by methods specified by us, such as email and password or Sign in with Apple.
2. You must appropriately manage your authentication information and must not allow third parties to use it.
3. Except in cases of our intentional misconduct or gross negligence, we are not liable for damage caused by unauthorized use by a third party.
4. You may request deletion of your account and related personal data through the Service or through procedures we provide. Handling of data after deletion is as set out in the Privacy Policy.

Article 4 (Content of the Service)

The Service is a personal tool that supports recording daily condition and body-related information. The Service does not provide a medical device and does not provide diagnosis, treatment, or medical advice. If medical judgment is required, please consult a physician or other qualified professional.

Article 5 (Free Plan and Paid Plans)

1. The Service includes features available for free and paid plans that provide designated additional features under names specified by us, such as “ond plus.”
2. Fees, renewal cycles, and the terms of any free trial for paid plans follow the displays within the app and product information on the App Store. You may cancel or change subscriptions by the prescribed methods based on your Apple ID settings.
3. If you purchase a paid plan by the prescribed method, the App Store payment terms apply. As a general rule, we do not hold payment methods themselves, such as your credit card number.
4. Some features, such as weather display, may use device location information or similar data. This is optional, and if you do not grant permission, only the relevant feature may be limited.

Article 6 (Prohibited Conduct)

When using the Service, you must not engage in the following acts.

• Acts that violate laws or public order and morals, or acts related to criminal activity
• Acts that infringe copyrights, trademarks, or other intellectual property rights of us or third parties
• Acts that place excessive load on servers, networks, authentication systems, or similar systems, or acts such as unauthorized access
• Impersonating another user or third party, or registering false information
• Acts that may interfere with operation of the Service
• Other acts that we reasonably determine to be inappropriate

Article 7 (Intellectual Property Rights)

Rights relating to programs, designs, trademarks, text, and similar materials concerning the Service belong to us or the rightful owners. The license granted under these Terms is a non-exclusive license to use the Service for private use and may not be transferred or sublicensed.

Article 8 (Disclaimer and Limitation of Liability)

1. We do not warrant that the Service will fit your specific purpose, have expected functionality, accuracy, or usefulness, or be free from defects.
2. Except in cases of our intentional misconduct or gross negligence, our liability for damage you incur in connection with use of the Service is limited to the amount you actually paid to us in the month in which the cause of the damage occurred, or JPY 1,000 if you used the Service for free. This does not apply where exclusion or limitation is not permitted under the Consumer Contract Act or other mandatory laws.

Article 9 (Changes to or Termination of the Service)

We may change, suspend, or terminate the Service at our discretion. Where your consent is required by law, we will notify you by the prescribed method.

Article 10 (Changes to these Terms)

We may change these Terms as necessary. The revised Terms become effective when displayed on the Service or by a method specified by us, and if you use the Service after the change, you are deemed to have agreed to the change.

Article 11 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. For disputes relating to the Service, the court having jurisdiction over our location is the exclusive court of agreed jurisdiction in the first instance.
